Transcript 'faxes 40 Lcnients furnished not later than the last day of of each year. Said "delinquent roll" shall be pub- icing the month of March following, for ten days, in ly paper published in the City of Houston; and the and Collector shall also be entitled to two dollars for ng each tract of land separately assessed, which shall agaiusf the delinquent taxpayer, and in case of suit ed as a charge against the property on which the tax id the A ssessor and Collector shall be entitled to re- isue any receipt to any delinquent taxpayer until this dvertising has been paid; and a failure to comply -o previsions by the City Assessor and Collector of ill be deemed a malfeasance and be cause for impeach- nl. Upon receipt of the above tax statements by the City Attorney lie shall, as soon as possible, institute suit in the proper com) to enforce the collection of taxes due the city, and shall tile suit on all of said statements furnished him by the City Assessor and Collector of Taxes by the next first of October after he has received them, and the failure on the part of the City Attorney to file suits on said statements by the first of October shall be deemed a malfeasance, and be a cause for impeachment; but a failure on the part of the City Assessor and Colleetoi of Taxes to prepare the "delinquent roll," or publish it for fin: required length of time, or furnish tax statements to the City Attorney, or a failure on the part of the city to file suits within the proper time, shall in no wise affect the liability of the delinqm nt taxpayer, nor shall such failure in any manner be relied on by way of defense against the payment of taxes due Hie city. Nothing but current money of the United States shall be collected or received in payment of taxes and licenses due or hereafter assessed; except coupons and scrip made receivable for taxes on the face thereof shall be receivable for all taxes except the bond tax. In cases where the State has instituted suit for taxes where taxes are due the city on the same property for the same years, that the city mav have the right to intervene in said suit, and
