Transcript January 17th,/72 Dear Son I see by reference to a memorandum made by your father that three tracts of land owned by estates he had administered ­­ upon was sold as folows by the Probate court at Brazoria Sept 7th,/41 by Wm P Scott Judge expenses of Administration $135 land sold for $112 of Ira Jones estate he says “I have demands which would more than cover the Gross assets, the estate did not pay the expenses or trouble of administering The memorandum does not say that the sale of the Ira Jones land took place at Brazoria and I am fully under the impression it was sold at Brenham Washington Co. by J L Farquhar Justice of the Peace at the time. I am perfectly certain your Father never sold the land I have paid Taxes on it ever since his death and he had form the time the Patent from the Gov. issued which was in Sept 28th 1854 I am certain our title if made would never be disturbed as there are no heirs except your fathers family I am willing to give a Bond for title until such time as the entire chain can be found which went with the sale of the 1478 acre tract belonging to Ira Jones Estate as a Colonist and single man which patent your father obtained from the Gov. long after his death, and in the same way by administering upon his estate You would find the whole --------------------------------------------------------- proceeding of the settling the estate in Brenham. My recollection upon this subject is clear and I confidently believe You [ ] in the sale [ ] of B in the probate court. Mr. Farquhar lives at his old place North of Barrington you might try calling upon him [and] get all some information You certainly can at Brenham Since writing the above Mr Ashe stoped in and I had him draw up the inclosed writing hoping it might facilitate matters in regard to the sale with DeCordova & R[ ]ter. I have not been well of late but at this time am up & feeling prety well. I can give bond for title [ ] time the amount of sale the purchase money g[u]aranting against all person claiming by through or under your father or myself as I well know he had not sold the land we have paid Taxes on it since /54 the Year the Patent Issued I will write you more at length in a few days, have received your letters and papers with the Pho tograph which I was glad to get . have seen Mary B[ ] &c As ever your loving Mother Mary Jones don’t be discouraged something will turn up in due time ----------------------------------------------------------------- [Handwritten document signed by Samuel S. Ashe, Justice of the Peace, accompanies Jones letter of January 17, 1872] State of Texas County of Harris To all whom it may Concern, be it known that before me Saml S. Ashe a Justice of the Peace duly Elected, qualified and commissioned, in and for the above named County and State, personally appeared before me Mary Jones who being by me duly sworn certifies that at the time of the death of Ira Jones she was the wife of Anson Jones the brother cousin of the said Ira Jones and that her husband did duly and lawfully ad- minister upon the Estate of said Ira Jones dcd. that he held demands against said Estate which more than covered the gross assets therof. And that said Estate did not pay the Expenses and trouble of administering that her husband the said Anson Jones came into possession of the landed Estate of said Ira Jones through[h] due process of the Probate Court of Washington County and that the title so derived to a certain tract or parcel of land, (160) acres of Land lying and situate in the County of Blanco, County of, and patented to the said Ira Jones __ __ __ __ ___ is still in the heirs of her said Husband and that he has never sold it or in any way alicated ------------------------------------------------------------ it from himself or his heirs. She further certifys that the said Ira Jones died intestate and childless and that She had never Sold Said land. In testimony of all which She has I have hereunto signed my name and Scroll for seal at Lynchburg this 18th Jany A.D. 1872 [signed] Mary Jones [seal] Sworn to and subscribed before me this 18th Jany 1872 Saml. S. Ashe J.P.H.C [Justice of the Peace, Harris County]
